1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18 or the age of majority in your jurisdiction, you may only use the Service with the permission and supervision of a parent or legal guardian.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that entity to these Terms.
2. Description of the Service
Our Service enables users to generate presentation content using artificial intelligence based on user inputs (prompts). This may include text, images, design layouts, data charts, and other presentation assets.
The Service is provided "as is." While we strive for high-quality and accurate outputs, we make no warranties regarding the suitability, correctness, legality, or originality of AI-generated content.
3. Your Responsibilities
You agree that you will not use the Service to:
- Violate any applicable laws or regulations, including local, state, federal, and international laws.
- Infringe or misappropriate any third party's intellectual property or privacy rights.
- Generate or distribute content that is unlawful, harmful, abusive, harassing, hateful, discriminatory, misleading, defamatory, or obscene.
- Circumvent or disable security features or reverse-engineer any part of the Service.
- Upload or input any information or content for which you do not have legal rights.
You are solely responsible for your use of the Service and any content you generate.
4. User Content and Inputs
You retain all ownership of the content you upload or input into the Service, including prompts, instructions, and any original media. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, and process your content solely to provide and improve the Service.
5. AI-Generated Content and Legal Responsibility
The content generated by the Service is produced by automated systems based on your inputs. You acknowledge and agree that:
- The generated content may unintentionally resemble existing copyrighted or trademarked works.
- We make no guarantee that generated content will be free of third-party rights, errors, or inappropriate material.
- You are solely responsible for reviewing the content and ensuring its accuracy, legality, and fitness for your intended use.
- You must not distribute or publish generated content that may infringe intellectual property, contain prohibited content, or violate applicable laws.

6. Prohibited Uses
You may not use the Service in any manner that:
- Promotes or incites violence, terrorism, or hate speech.
- Harms or exploits minors.
- Disseminates misinformation, false claims, or deep fakes.
- Attempts to deceive users or impersonate individuals or brands.
- Violates export control or trade sanctions laws.
- Uses automated tools or scraping methods to abuse the Service.
We reserve the right to suspend or terminate your access to the Service at our sole discretion if you violate these Terms or applicable law.
7. Intellectual Property
All rights in the Service, including software, design elements, and models, are owned by NextMind App or its licensors. These Terms do not grant you any ownership interest in the Service or its content (except your own inputs).
You may not copy, modify, distribute, or create derivative works based on our Service or content (other than content you have generated and have rights to use).
8. Privacy and Data Use
Your privacy is important to us. We process your data in accordance with our [Privacy Policy], which complies with applicable U.S. privacy laws, including the California Consumer Privacy Act (CCPA) and the Washington Privacy Act (WPA), where applicable.
We do not sell your personal data. You may request access to, or deletion of, your personal data at any time by contacting support@nextmindapp.com.
9. Third-Party Services
The Service may integrate with or rely on third-party platforms such as presentation software (e.g., PowerPoint). Your use of these services is governed by the respective third parties’ terms of service and privacy policies.
We are not responsible for the actions, content, or availability of any third-party services.
10. Account Termination
We may terminate or suspend your access to the Service at any time, without notice or liability, for any reason, including violation of these Terms or applicable law.
Upon termination, your right to use the Service will immediately cease. We may delete your account and any associated data, subject to applicable law.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available.” We make no warranties of any kind, express or implied, including but not limited to:
- Accuracy or reliability of generated content.
- Merchantability or fitness for a particular purpose.
- Non-infringement or absence of errors or interruptions.
Some jurisdictions do not allow the exclusion of implied warranties, so some disclaimers may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
- We are not liable for any indirect, incidental, consequential, punitive, or special damages, including loss of profits or data.
- Our total liability to you for all claims arising out of or related to the Service shall not exceed the amount paid by you (if any) for the Service in the past 12 months.
13. Indemnification
You agree to indemnify and hold harmless NextMind App, its affiliates, officers, employees, and partners from any claim, loss, damage, liability, or expense (including attorney’s fees) arising from your use of the Service, your content, or violation of these Terms.
14. Export Control and Sanctions Compliance
You may not access or use the Service if you are located in a country or region subject to U.S. government sanctions (including but not limited to Cuba, Iran, North Korea, Syria, and Crimea) or are a party listed on U.S. government restricted party lists.
You agree to comply with all applicable U.S. export control and sanctions laws and regulations.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles.
Binding Arbitration
All disputes arising under or relating to these Terms or the Service shall be resolved by final and binding arbitration administered by the American Arbitration Association in Seattle, Washington. Judgment on the award may be entered in any court of competent jurisdiction.
You and NextMind App waive the right to a jury trial or to participate in a class action.
16. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you through the Service or via email. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance.
